Construction Accident Related Injuries

The New York State Labor Law and the regulations that have been passed under it contain safeguards for workers that date back to before the founding of the United States. Indeed the first time we find any mention of the concept is in the Book of Leviticus!

More recently, but still long in our legal tradition, the State of New York enacted what is commonly known as the Scaffold law that essentially requires property owners and contractors to be sure employees will not fall from an elevation or be injured by falling objects. That statute - virtually a century old - is section 240 of the Labor Law.

Federally, in 1996, the Occupational Safety and Health Administration (OSHA)’s new scaffold standards took effect. Those regulations are also a part of the arsenal available to us at Keegan & Keegan, Ross & Rosner to help protect the rights of injured workers because still today, many Construction Standard violations occur through the improper use of scaffolding. Common violations include inadequate bracing, no guardrails, unsafe access and no pins in scaffolding to prevent uplifting just to name a few.
 

The injuries are frequently severe: fractures of the humerus, tibia and fibula - the long bones of the legs - are common in scaffolding accidents and the fact that a bone is broken is clear evidence of the seriousness of the injury. Calcaneus fractures (heel bone), knee injuries such as tears of the ACL (a key ligament in maintaining knee stability) and the meniscus are likewise frequent and often more difficult for the medical profession to diagnose and treat and tougher for the victim to obtain full and fair compensation.
